General Terms and Conditions (GTC)
Association Justice and Family Law Supervision Swiss
1.1. the association “Justiz und Familienrechtsaufsicht Swiss” (hereinafter “association”) is an independent, non-profit association based in Switzerland.
1.2. the purpose of the association is to promote the transparency, monitoring, reform and improvement of procedures in the justice and family law system (child and adult protection).
1.3. these General Terms and Conditions (GTC) govern the memberships, rights and obligations of the members as well as the general conditions for services of the association.
2. membership
2.1 Types of membership
The association offers the following memberships:
- Ordinary membership: For natural and legal persons who wish to become actively involved.
- Supporting membership: For natural or legal persons who wish to support the association financially.
- Honorary membership: Is awarded by the Board of Directors to persons with special merits, commitment and work.
2.2 Admission
2.2.1 Membership can be acquired automatically through a written, verbal and/or annual membership application.
2.2.2 The Executive Board decides on the admission of new members. No reasons need to be given for a rejection.
2.3 Membership fees
2.3.1 The association charges annual membership fees, which are determined by the General Assembly. The current membership fee is set at 120.00.
2.3.2. Membership is payable in advance. Membership is always valid for one calendar year.
2.3.3. A refund of the membership fee in the event of withdrawal during the year is excluded.
2.4. Rights and obligations of members
2.4.1. Members have the right to participate in association meetings and to submit motions.
2.4.2. Only full members are entitled to vote.
2.4.3. Every member undertakes to support the objectives of the association and to comply with the GTC.
2.5 Termination of membership
2.5.1 Membership is terminated by:
- Voluntary resignation (written notice of termination with one month’s notice to the end of the year). Membership is then automatically extended for a further 12 months.
- Exclusion by the Board of Directors due to serious violations of the association’s interests.
- Death or dissolution (in the case of legal entities).
2.5.2 An exclusion shall be made in writing. The member concerned may lodge an objection within 14 days.
3.1. the association organizes information events, workshops and consultations on the subject of justice and family law.
3.2. members can receive preferential access to certain association offers.
3.3. the association does not provide legal advice or representation, but serves exclusively to provide information and support and networking with business partners of the association.
4.1. the association is not liable for damages arising from the use of its information or services.
4.2. the use of the association’s services is at the member’s own risk.
5.1. members’ personal data will only be used for association purposes and will not be passed on to third parties.
5.2. every member has the right to information about the stored data and its deletion in accordance with the statutory provisions.
6.1. amendments to these GTC may only be adopted by the general meeting.
6.2. should individual provisions of these GTC be invalid, this shall not affect the validity of the remaining provisions.
6.3. the place of jurisdiction for any disputes shall be the registered office of the association in Zurich.
